On Wednesday, 08 March 2017, U.S. District Judge Derrick Watson allowed Hawaii’s amended lawsuit disputing President Donald Trump’s revised travel ban to continue forward. A formal hearing for the lawsuit is set for Wednesday, 15 March 2017, the day before Mr. Trump’s revised travel ban takes effect.
According to “Hawaii News Now”, Hawaii is the first state to sue over Mr. Trump’s revised travel ban.
According to State of Hawaii Attorney General Douglas Chin, the travel ban harms Muslims living in Hawaii.
“Hawaii News Now” adds this bit of analysis concerning the travel ban:
“The state’s previous suit had been on hold while a nationwide injunction on the initial ban remained in place. Watson granted the state’s request to lift the stay so it could file the amended lawsuit.”
“Attorneys for the state argue the new executive order “suffers from the same constitutional and statutory defects” as the president’s first mandate.”
“Hawaii was among a number of states that sued over the president’s first travel ban. The new order still bars new visas for people from six Muslim-majority countries and temporarily shuts down America’s refugee program.”
State Attorney General Doug Chin has called the order, issued Monday, “nothing more than Muslim ban 2.0.”
Let’s see if Hawaii’s legal action can mitigate some of the restrictive portions of the new travel ban. So far, only certain citizens from Iraq are exempt from the travel ban, which still affects Muslim residents of six predominately Muslim countries in the Middle East.
